Superior Court
The Polk County Clerk of Superior Courts Office wishes to keep and maintain all records and accomplish the prompt and orderly disposition of the business of the courts as required by law and to provide quality and professional service to the citizens of Polk County.
The Clerk of Superior Court is established in the Constitution of the State of Georgia. The clerk is one of the four constitutional officers who can be found in each of the 159 counties in the state, the other three constitutional officers being the Sheriff, the Tax Commissioner and the Probate Judge. The Clerk’s duties are statutory in nature and are found in the Official Code of Georgia in hundreds of statutes created by the state legislature. In addition, the clerk has an obligation to follow the court rules for each court they may serve. The clerk is an elected position in each county, providing personal service directly to the public on a daily basis though direct contact with the clerk or through contact with his or her deputy clerks.
The clerk and deputy clerks desire to help all parties that ask for assistance and will attempt to do so. The clerk and deputy clerks are strictly forbidden to practice law by statute and are restricted in what they can give advice about or assistance in preparing. Any assistance given by this office should not be considered legal advice. Sound legal advice must only come from a licensed attorney and the clerk ’s office encourages all parties to seek competent legal advice. We ask that you be understanding with our staff as we attempt to assist you, knowing the limitations we face in assisting each individual party to a case.
JURY DUTY
The jury information number is 770-749-2036.
Jurors are instructed to call the jury line on Sunday evening prior to the date they are to report.
During a regular trial week, jurors will be instructed to call the jury information line each night after 6:00pm to receive instructions regarding their service.
Jurors are paid $40.00 per day for their service.
If you are given instructions to call the number the next night, and not to report, you will not be paid for that day. You will need to resume your schedule.
NOTE: There is Audio Aid Equipment Available upon request for those needing hearing assistance.
MOTION COURT
Motion Court is held every Tuesday and Wednesday at 9:00am.

3rd Monday in March and July.
Grand Jury summoned in July will be recalled in October, if needed.
TPOs
There is a legal advocate to file TPOs provided by our House 770-748-6633.
The clerk's office does not perform criminal searches or title searches. The public is welcome to use our public search terminals during regular office hours.

FILING ACTIVITY NOTIFICATION SYSTEM | FANS
Polk County Superior Court Clerk’s office, in conjunction with the Georgia Superior Court Clerks’ Cooperative Authority, is pleased to offer the Filing Activity Notification System - FANS. FANS provides Georgia citizens with tools to monitor activity regarding their property and records.
FANS is a free, voluntary, opt-in program that can be used to send electronic notifications of filing activity to individuals who create notifications in the system. The notifications generated by this system are not guaranteed to be accurate or complete, and use of the system is subject to an acknowledgment of these conditions.
